GENERAL CONDITIONS OF CONTRACT FOR THE USE OF THE WEBSITE

Before using this website, please read the present general conditions of contract. Their full acceptance provides the necessary and imperative condition to access and use the content and the services offered through this website.

1. Definitions.
“AIE” means Associazione Italiana Editori (Italian Publishers Association), with its registered office at Corso di Porta Romana n. 108, 20122 Milan, Italy, (VAT number 01416360152, Tel. +39 0289280800, Fax +39 0289280860, e-mail: progetti@aie.it), as coordinator of the ALDUS Project.
“Website” means the website www.aldusnet.eu owned by AIE as coordinator of the ALDUS Project.
“User” or “You” means the user of the Website.
“Parties” means the User and AIE.
“Services” means services and content provided through the Website to the User, in accordance with the following general conditions of contract.

2. Subject matter of the contract.
This agreement contains the general conditions of contract applicable to the User relevant to the use of the Website and the Services available through the Website.
The present general conditions of contract regulate the use of the Website, the responsibility of the User and, together with other aspects, the limits of the responsibility of AIE.
By accessing any part or section of the Website, the User accepts to be legally bound by the present general conditions and commits to comply with the same.
In the case You do not agree with any of the present general conditions, please refrain from using the Website.
The User must be an adult (at least 18 years of age) and, therefore, to have an age sufficient to undertake the legal liabilities and responsibilities resulting from the use of the Website. On the contrary, the User must refrain from utilising the Website.
The User declares to be informed that some Services or the fruition of specific parts of the Website are subject to further contractual provisions as indicated from time to time on the Website.
The access to the Website and the use of the Service are offered free-of-charge, based on full acceptance by the User of the present general conditions of contract.
The User will take full responsibility and cost for the configuration of his/her computer and the installation of software for connection, as well as charges for connecting to the Internet (telephone charges included) in according with his/her supplier rate.

3. User’s data and cookies.
The User acknowledges and accepts that his/her personal data may be processed by AIE according to the Privacy information notices provided to the User through the Website.

4. Website and Services acceptable use.
The User can use the Website and the Services only for legitimate activities and must not use the Website and the Services for any activities that turn into any violation of the rights of AIE, the partners of the ALDUS Project or third parties.
It is expressly forbidden to utilise any part or section of the Website and Services for directly or indirectly commercial or advertising activities of any kind, unless authorised in written by AIE.

5. Modification, suspension and interruption of the Services.
AIE reserves the right to modify the Website and Services characteristics, without any type of prior notice or obligation.
AIE reserves the right, in its sole discretion and without notice, to suspend or interrupt (temporarily or definitively), change, modify or to restrict the use and accessibility of the Website and Services at any time, disclaiming any responsibility with regard to the User.

6. Limitation of liability.
While every effort has been made by AIE and the partners of the ALDUS Project to ensure the high quality and accuracy of the Website, the Services included or available through the Website can contain inaccuracies or errors.
AIE does not issue any type of guarantee or declaration relevant to the suitability, reliability, availability of the Website and regarding the accuracy of the Services.
Within the limits consented by the law, AIE and the partners of the ALDUS Project cannot be held responsible towards the User and eventual third parties for direct or indirect damages of any type deriving from, or in any way connected to, the use of the Website and its Services, for the delay or impossibility to utilise the Website or its relevant Services, to the supply or lack of supply of the Services, or any information, contents or service obtained through the Website.
Within the limits consented by the law, AIE declines every responsibility relevant to the consequences deriving from the possible malfunctions of the Website and/or for damages that can derive both towards the User and eventual third parties.
In no case shall AIE be responsible towards the User, towards persons directly or indirectly connected to the User and towards third parties for the damages, the loss and costs supported in consequence of suspensions or interruptions in the operation and availability of the Website and the Services due to force majeure or fortuitous events.
The Services are available without guarantee of any kind, explicit or implicit. No guarantee is given that the use of the Website shall be exempt from errors; (i) regarding the results that can be obtained utilising the Website, or (ii) regarding the accuracy, reliability or quality of any content supplied or made available through the Website.
AIE will not be liable for any delay, malfunction and interruption of the Services due to a) ordinary and/or extraordinary service or updating of its technological equipment, b) incorrect use of the Services by the User, c) malfunctioning of User’s equipment, d) total or partial interruption of Internet access due to the Internet provider chosen by the User.
Due to the technical limitations regarding the protection of communication through the Internet, AIE does not represent or warrant that information or data provided by You through the Website or visualised by the User (eventually in reserved areas of the Website too) will not be accessed by unauthorized third parties.

7. Links to other websites.
The Website can contain references to services supplied by third parties or links to third party websites.
AIE does not guarantee and does not assume any responsibility regarding the contents and information supplied by such third parties, their completeness or accuracy.
AIE does not guarantee and is not in any way responsible for the contents, the availability, the functioning and the fulfilments of any website that can be linked to this Website or from which access to this Website is available.
The linking to the present Website through hyper textual links to its pages can be freely carried out.
Any linking techniques to prevent the recognition of (or to mask) the authorship of the content (framing) are strictly prohibited.

8. Trademarks.
All the figurative and denominative trademarks, registered or not, and logos used in the Website are the exclusive property of the respective owners.
The use or reproduction, in any form and method, of such trademarks and logos is prohibited without a written authorisation by the relevant rights owner.

9. Intellectual property rights and User obligations.
The User recognizes that the written material, the data, the software, the photographs, the graphs, the videos, the graphics, the music, the sounds, the images, the illustrations, the designs, the icons and any other material present on the Website are protected by copyright or other intellectual property provisions and are the exclusive property of AIE, the partners of ALDUS Project and/or third parties.
The User shall make use of the Website and the Services only in accordance with the present terms and conditions and undertakes to respect intellectual property rights on the materials and content provided through the Website.
Any act of disposition or use of the material contained in the Website and in the Services, in any form, are limited to what allowed by these general condition, unless a written authorisation is granted by AIE, the partners of ALDUS Project and/or the respective owners of the rights.

11. Severability.
In case any provision of these general conditions of contract shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

12. Entire agreement.
The present general conditions of contract represent the entire agreement between the User and AIE relevant to the utilization of the Website and Services and supersedes any prior statement or representation.
AIE reserves the right, at its complete discretion, to modify the present general conditions at any time, advising of the new general conditions on the Website. The new general conditions of contract shall be in force and effective from the time that they are published on the Website.The utilization of the Website by the User will be subject to the general conditions published on the Website at the time of utilization of the Website itself.
The headings of the clauses utilized herein are for convenience only and they do not affect interpretation.

13. Jurisdiction.
Without prejudice to the compulsory provisions of the law in favour of the “consumers”, any controversy arising from these general conditions of contract will be subject to the exclusive jurisdiction of the Court of Milan, Italy.

14. Applicable law.
These general conditions of contract will be governed by and interpreted in accordance with the laws of Italy.
For all herein expressly not provided for, the provisions of Italian law are in force, and in particular, for “consumers”, the provisions of Italian Legislative Decree n. 206/2005 (Consumer Code).
