What are cookies?

Cookies are small text files that websites visited by users send and store on the users’ computers or mobile devices, in order for them to be sent again to the same sites at the next visit. It is thanks to cookies that the site remembers actions and preferred options of the users (such as, for example, the login data, the language chosen, the size of the characters, other display settings, etc.) so that they don’t have to be specified again when the user goes back to visit this site or browses from one page to the other of the site. Cookies, therefore, are used for information authentications, monitoring of sessions and storage of information concerning the activities of the users accessing a site, and they may also contain e unique userid code that allows to track the browsing of the user through the site itself for statistical or advertising purposes. While browsing the site, the user can also receive on his/her computer or mobile device cookies of sites or web servers different from the one he/she is visiting (the so called “third-party” cookies). Some operations could not be carried out without the use of cookies, that in certain cases are therefore technically necessary for the very working of the site.

There are several types of cookies, depending on their features and functions, and these can remain in the user’s computer or mobile device for different periods of time: the so called session cookies, that are automatically deleted when the browser is closed; the so called persistent cookies, stored on the user’s computer, tablet or mobile device until a set term.

Under the rules in force in Italy, not always is an express consent by the user required for the use of cookies. In particular, it is not required for the so called “technical” cookies, i.e. those used with the only purpose of transmitting a communication on an electronic communication network, or to the extent strictly necessary to provide a service explicitly requested by the user. In other words, these cookies are essential for the operation of the site or necessary to carry out activities requested by the user.

Among technical cookies, that do not require an express consent to their use, the Italian Data Protection Authority (see gen. prov. “Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies – 8 May 2014”) also includes:

  • “analytics cookies” where used directly by the website manager to collect information, in aggregate form, on the number of users and on how they visit the site (on the contrary, for third-party analytics cookies, the previous consent of the user might instead be necessary: see prov. of the Italian personal data protection authority of 5 June 2015: “Elucidations concerning the implementation of cookie regulations”);
  • browsing or session cookies (for authentication, to purchase something, etc.);
  • functional cookies, that allow users to navigate based on a series of selected criteria (for example, language, products selected for purchasing) in order to make improvements to the service offered to users.

For the so called profiling cookies, vice versa, i.e. those cookies aimed at creating users’ profiles and utilized to send ads messages in line with the preferences shown by the user during navigation, a previous consent by the user is required.

Types of cookies used in the Site
